1. Scope of terms & conditions: The use of the website as well as all deliveries and services from Christina Pott are based exclusively on the following general terms and conditions. Regulations deviating from these conditions, in particular the general terms and conditions of the contractual partner, do not apply, even if Christina Pott does not expressly contradict them. Deviating individual agreements between Christina Pott and her contractual partners must be made in writing.
2. Conclusion of contract and withdrawal: Christina Pott undertakes to accept the order of the contract partner under the terms of this website, including the general terms and conditions. In the event of spelling, printing or calculation errors on the website, Christina Pott is entitled to withdraw from the contract without the contractual partner having any claims. Oral information and promises, brochures and advertising statements of any kind, in particular descriptions, images, drawings, samples, quality, condition, composition, performance, consumption and usability information as well as the dimensions and weights of the contractual goods are non-binding, unless expressly stated are designated as binding. They do not represent an assurance or guarantee of any kind whatsoever. Slight deviations from the product information are considered approved, provided they are not unreasonable for the contractual partner.
3. Delivery: Unless otherwise agreed, delivery will be made to the delivery address specified by the contractual partner. Information on delivery times is non-binding. An agreed delivery deadline is met if the goods have been submitted for transport by the deadline or readiness for dispatch has been notified by the deadline. In the event of delivery delays due to force majeure, natural disasters, strikes in their own companies, suppliers or with transporters or due to other circumstances for which Christina Pott is not responsible, Christina Pott is entitled to make up for the delivery after the reason for the hindrance no longer applies. However, both parties can withdraw from a concluded contract in whole or in part if one of the aforementioned events leads to a delivery delay of more than three months beyond the agreed period. However, further claims by the contractual partners are excluded. Christina Pott is entitled to make partial deliveries of goods.
4. Maturity of the purchase price and payment methods: The purchase price is due with the order confirmation. Payment can be made by bank transfer, PayPal or credit card. In the case of a bank transfer, the specified delivery times begin with the receipt of the money on Christina Pott's account. Christina Pott reserves the right to exclude payment methods.
PREPAYMENT
The total purchase price will be transferred before delivery. The goods will be shipped after receipt of payment.
Paypal
Total purchase price is paid by PayPal before delivery. After the payment has been confirmed by PayPal, the goods will be shipped.
Credit card
Total purchase price is paid by credit card prior to delivery. After Stripe has confirmed receipt of payment, the goods will be shipped.
5. Shipping The shipping costs are: Within Germany: 9.00 euros
Europe and Switzerland: 20.00 euros
World: 30.00 euros
The dispatch takes place within Germany by DHL in an insured and traceable package. Outside Germany and with a goods value of more than 500.00 euros, insured and traceable shipping is carried out with Bertram Juwelier Service. This cooperates with UPS. Prices vary depending on the type and amount of insurance.
6. Delivery times Delivery time: 7 - 12 working days after receipt of payment. 7. Retention of title: Until all claims against the contractual partner have been settled in full, the delivered goods remain the property of Christina Pott. If the contractual partner is in arrears with one or more payments in whole or in part, if he suspends his payments or if insolvency or judicial settlement proceedings have been initiated against his assets, then the contractual partner may no longer dispose of the reserved goods. In such a case Christina Pott is entitled to withdraw from the contract or to take back the reserved goods for the purpose of other utilization or to revoke the contractual partner's authorization to collect the claims from the resale. Christina Pott can then request information about the recipients of the reserved goods, notify them of the assignment of the claims and collect the claims herself. 8. Warranty and liability: In the event of defects in the goods ordered or in the case of the lack of warranted properties, Christina Pott is initially entitled, at the buyer's option, to repair the defective item or to deliver a replacement. After the second failure or if it is impossible to repair the defective item or for a replacement delivery within a reasonable time, the contractual partner is entitled to demand a reduction in the purchase price (reduction) or cancellation of the contract (conversion). The contractual partner must report obvious defects in writing immediately, but no later than two weeks after receipt of the delivery from Christina Pott. Christina Pott must be notified in writing of other defects that cannot be discovered within this period even after careful inspection. Excluded from the guarantee are damage that can be traced back to natural wear and tear, improper use and insufficient or incorrect care. Unless otherwise stated below, further claims by the customer - regardless of the legal grounds - are excluded. Christina Pott is therefore not liable for damage that did not occur on the delivery item itself. In particular, Christina Pott is not liable for lost profit or other financial losses of the contractual partner. The warranty is 2 years and begins with the delivery of the goods.
9. Data protection and data backup: Insofar as the contractual partner transmits data to Christina Pott in whatever form and format, he will make backup copies of it. In the event of a loss of data, Christina Pott is only obliged to compensate for damage that could not be prevented by backup copies made by the contractual partner, subject to the limitations of liability mentioned above. If the contractual partner loses data while using Christina Pott's website, Christina Pott is in no way liable. Christina Pott is entitled to save all personal data that is required in connection with the use of the website and also to transmit it to third parties, insofar as it is necessary for the initiation, implementation and processing of a user relationship. Any further use of personal data depends on the consent of the user. 10. Return policy Right of return: The goods received can be returned within 2 weeks without giving a reason. The period begins with receipt of the goods and this instruction at the earliest. Only in the case of goods that cannot be shipped by parcel (e.g. bulky goods) can the return be made by means of a return request in text form, e.g. B. by letter or e-mail. The timely dispatch of the goods or the return request is sufficient to meet the deadline. Severability clause: Should individual provisions of these terms and conditions or the contract concluded with the contractual partner be wholly or partially ineffective, this does not affect the effectiveness of the rest of the contract
